General Terms and Conditions Le Belle Health
General terms and conditions of Le Belle Health, Practice for Orthomolecular Therapy, Nutrition, and Lifestyle Coaching, located in Rotterdam, at Grindweg 662, 3055 VD, and registered with the Chamber of Commerce under number 86766147. Le Belle Health also refers to Isabella van ‘t Wout, the treating orthomolecular therapist, nutrition, and lifestyle coach.
Le Belle Health reserves the right to change these general terms and conditions for the future. Changes to the general terms and conditions will only be effective after being clearly communicated by Le Belle Health.
If a provision of these general terms and conditions is found to be invalid due to the application of law, regulations, or a final decision of a competent court, all other provisions of the general terms and conditions will remain in full force.
- General
The term "client" refers to the person to whom Le Belle Health provides advice and guidance.
These conditions are part of every agreement between Le Belle Health and a client regarding treatment and/or the provision of services and/or goods.
These conditions also apply to agreements with Le Belle Health for the execution of which third parties need to be involved.
If a situation arises between the parties that is not regulated in these general terms and conditions, this situation shall be assessed in accordance with the spirit of these general terms and conditions.
- Treatment
The agreement between Le Belle Health and the client is entered into for the duration of the treatment.
Le Belle Health will carry out activities related to nutrition and lifestyle to the best of its knowledge and ability and in accordance with the requirements of good craftsmanship; Le Belle Health has an obligation of effort. This is based on the current state of knowledge.
The client undertakes to provide relevant information to Le Belle Health through written and oral anamnesis/intake conversations and ensures that all data that may reasonably be important for the proper execution of the treatment are communicated to Le Belle Health in a timely manner.
- Hindrance
Appointments that cannot be kept must be canceled at least 24 hours before the treatment—weekend days not included. In case of non-cancellation or cancellation within 24 hours before the appointment, Le Belle Health reserves the right to charge for the reserved time.
- Suspension
Le Belle Health has the right to suspend agreed consultations and/or activities if it is temporarily unable to fulfill its obligations due to circumstances beyond its control or of which it was not aware or could not have been aware at the start of the guidance, or due to illness. If performance becomes permanently impossible, the agreement can be dissolved for the part that has not yet been fulfilled. Neither party is entitled to compensation for the damage suffered as a result of the dissolution.
- Payment and Collection Costs
Currently, consultations are not eligible for reimbursement by health insurance. For the most up-to-date rates, you can visit the website https://www.lebellehealth.shop.
Payment must be made immediately after treatment or within 7 days of the invoice date in the currency in which it was invoiced.
If the client fails to pay a bill on time, the client is automatically in default without further notice. As long as the client fails to fulfill his/her obligations, all costs associated with the collection of the relevant claim will be charged to the client. These costs expressly include the costs of collection by a collection agency and legal costs.
- Reservation of Rights
Le Belle Health reserves all rights to advice, plans, documents, images, and/or related information and knowledge, even when costs have been charged or improvements have been made afterward, whether or not at the request of the client. The aforementioned items may not be copied, wholly or partially, without written permission from Le Belle Health, other than for internal use by the client, nor be handed over or disclosed in any other way, nor be used or made available by the client other than for the purpose for which they were provided by Le Belle Health.
- Liability
Le Belle Health is not liable for any damage of any kind caused by the use of incorrect and/or incomplete data and/or undisclosed health aspects provided by or on behalf of the client. Le Belle Health is also not liable if advice is not followed or is followed incorrectly.
The advice and/or guidance of Le Belle Health are result-oriented by nature, without guaranteeing results. Le Belle Health has taken the utmost care in the accuracy and completeness of the digital, written, and/or oral information provided by her. If it nevertheless appears that this information is incorrect and/or incomplete, Le Belle Health is not liable for any damage of any kind resulting from this.
Le Belle Health excludes any liability for damage or injury or illness arising from or related to the client's compliance with advice provided by Le Belle Health, unless there is intent or gross negligence on the part of Le Belle Health.
Le Belle Health is never liable for business damage, loss of income, and the like, for whatever reason. Le Belle Health is never liable for damage caused by intent or gross negligence by third parties.
Le Belle Health is in no way liable for the quality and composition of the supplements, products, and/or medicines recommended by her. The supplier of these supplements, products, and/or medicines is responsible for this.
The client is fully responsible for reporting supplements, products, and/or medicines recommended by Le Belle Health to his/her (family) doctor and, if applicable, his pharmacy or treating specialist.
If and insofar as Le Belle Health may be liable for any damage, the liability of Le Belle Health is limited to the amount of the payment by its insurer in that case.
- Privacy
Le Belle Health will treat all information regarding the client obtained during the execution of the treatment confidentially and will not disclose this information to third parties, except to the extent that Le Belle Health is obliged to do so or has obtained permission. - Termination of Agreement
Unless otherwise specified, the agreement is entered into for the duration of the treatment.
- Applicable Law and Disputes
Only the civil court with jurisdiction in the place of establishment of Le Belle Health is competent to hear disputes. Dutch law applies.
Parties will only appeal to the court after they have made every effort to settle a dispute through mutual consultation.
- Complaints
Le Belle Health is affiliated with CAT, Collective Alternative Therapists, and GAT, Dispute Resolution Alternative Therapists. If you have complaints about the treatment, it is advisable to report them within a maximum of 6 weeks. If a personal conversation or mediation does not achieve the desired result, a complaints procedure can be used. The complaints officer of CAT will help formulate the complaint. Sometimes, just telling the story is enough, and further action is waived. Sometimes, mediation can take place, and an agreement is made about the next steps. If it is not possible to resolve the dispute with Le Belle Health and the help of the complaints officer, the complaints officer will refer to the GAT Dispute Resolution. Any claim expires 12 months after the last treatment date.
